Recorded in ye Court records of Stafford July the 9th 1690p.162 EDWARD SMITH gave to CONSTANT BARTON ye daughter to EDWARD BARTON one gray mare about three year old branded with liteon ye neare shoulder Recorded in ye County Court records of Stafford July the 9th Anno 1690
p. 63 To the Worshipful Court (OCT 1700)The humble petition of BURR HARRISON sheweth that your Petitioner intermarrying with ye Widow of EDWARD SMITH deced and she dying your Petitioner desires your worships would be pleased to grant ye Petitioner the guardianship of EDWARD SMITH'S children to wit EDWARD & KATHERINE SMITH and petitioner shall ever pray

now all men .. that I BURR HARRISON of Stafford County Guardian or overseer appointed by the Court of said county unto EDWD & LETTICE SMITHS three children to wit WM., EDWD. & KATH: SMITH grandchildren to ANN SCARLET late of said county deced do for divers good causes .. for the just sum of 18000 pounds of good Tobo & cask in hand already paid per GEORGE MASON Gent. of said county admr. of JANE GREEN who was appointed Admr. of Ann Starlets will .. for & in consideration of the use benefits interest and profits as the said sum afsd may accrue to my Interest & benefit by having use of ye sd sup of Tobo until the children or orphans of said Smith shall be at age or time to claim the sd sum of Tobo do discharge the above said George Mason admr. of Jane Green who was appointed admr. of no Scarlet of said county deced from the claims of the three children of said Edwd. & Lattice Smith for their three legacies of several sums of Tobacco & cask given them by their grandmother Ann Scarlet as per her will on record and from the claims of survivors of them or kindred claiming I Burr Harris (sic) do by these presents bind myself in the full & just sum of thirty thousand pounds of merchantable Tobacco in cask to be paid unto George Mason .. this 9th Octr. 1702.

Martin Scarlet devised by his Last Will bearing date 5th January 1705/06 unto WILLIAM SMITH son of EDWARD & LETTICE SMITH & in case sd. William death before he attained twenty one years of age to the heirs of Lettice Smith forever, who is the SCARLET HANCOCK partie to these presents .. land bounded upon the river side .. corner tree of RICHARD SHIPWAY; into woods; on west side a Path leading to PARSON WAUGH'S; land of JOHN FOSSAKER
