      MAGGART vs. CROCKETT {VA Chancery Court (Staunton) Ended Causes, 117/40}
      “John Maggart made an entry into Rockbridge for 200 acres on Bratton’s Run. Shortly afterwards John Dunlap made an entry on a
      part of John’s tract. Died, leaving it to his daughter Polly HODGE. John DUNLAP had a brother, James. MAGGART is a German.

      This suit, which is rich in DUNLAP genealogical content, includes a copy of the 19May1808 will of Ann DUNLAP, John2
      (Alexander1)’s widow. Ann lists “my six children, to wit. Alexander DUNLAP, Betsy GAY, James DUNLAP, Ann BRATTON, John
      DUNLAP, and Polly CROCKET”, and also names “my grandson Samuel Dunlap HODGE”. Meanwhile, the accompanying copy of her
      husband John’s will, refers to his daughter Mary Hodge and Mary’s son James Hodge. From this we may infer that daughter Mary was
      married first to a HODGE, by whom she had sons Samuel and James, and that she married, second, Robert CROCKETT—both of these
      familiar Big Calfpasture names. Ann’s will also names her grandson Robert Gay—resumably a son of her daughter Elizabeth GAY.

      Associated with the papers of this suit is a receipt for the $20 dated 15Jun1809, annotated “received of Major John GAY” (identifying
      him thus as John2 GAY Esq, son of John1
      ) “for the building a gallery in Lebanon Meeting House for the use of the negroes of said
      Congregation”. {Chalkley “Circuit Court Causes Ended”, 191-192}

      I’ve downloaded all the documents of this case and examined the key ones—the complaint, the joint answer by the defendants, the copies
      of the wills of father John2 and mother Ann, and one undated court judgement paper (there may well be others in this case that dragged
      on until 1817), and sampled a few of the remaining papers of this case, which totaled 277 in number. Of interest is the fact that evidently,
      it was John2a’s oldest son Alexander3 that got up this suit, subscribed the names of at least some of his siblings without their permission,
      and who later formally rejected participation in it, and misrepresented what was owing to him and others. The large number of documents
      in this case appear to be the receipts, affidavits, etc. that were collected and kept by defendant John Gay, Esq., who was called “friend” and
      made a co-executor in Ann’s will, along with her son James, and who had been a county justice from the age of 21. From this and another
      case where Gay was a defendant (and was held blameless in the judgement) it’s evident that he was not only the sole of rectitude, but also
      meticulous in his record keeping.

      Robert Crockett, son of Alexander and Mary [Kerr] Crockett, was born ca.
      1760-1768 in Augusta County Virginia. Robert moved from Virginia to Kentucky
      with his mother and stepfather Alexander Rhea between 1783 and 1788, when
      Alexander Rhea was found in Bourbon County Kentucky records. Robert was
      in Montgomery County, Kentucky by 1797. He married Mary Dunlap Hodge,
      the widow of Samuel Hodge and daughter of Ann and John Dunlap, on
      September 18, 1804 in Kentucky. Robert and Mary gave affadavit in Montgomery Co., KY
      in 1808. Bath County was formed from part of Montgomery County in 1811.
      Robert was living in Bloomfield, Bath County Kentucky at the time of the
      1820 US Census. He was still living there in 1829. Robert Crockett
      is buried in Owingsville, Bath Co., Kentucky. He and Mary had a son named ********
      John Alexander Crockett. There was probably at least one other son, shown
      as a male age 10<16 on the 1820 census and a male < 10 in the 1810 census.
